What To Do If You Get A Traumatic Brain Injury In Chicago

July 21, 2023

Blows to the head should always be taken seriously, even if they don’t feel that violent. Traumatic Brain Injuries can result from blunt force trauma to the brain, as well as through piercing injuries that make it past your skull. As you know, your brain is a critical organ— it’s the control center for your entire body. And injury to your brain, especially if left untreated, can have devastating consequences. Let’s talk about TBIs and how you can seek justice for your injury in Chicago.

What Can Cause a TBI?

Traumatic Brain Injuries can come from a lot of places, honestly. For such a critical organ, the brain is a bit too easy to injure. The following are incidents that can lead to TBIs:

  • Car accidents
  • Truck collisions
  • Sports injuries
  • Horseback riding injuries
  • Animal kicks
  • Slips and falls
  • Gunshot wounds

How Do You Know If You Have a TBI?

To be certain, you need a doctor’s diagnosis. However, sometimes you miss getting injured— or the severity of the injury. If you or a loved one notice any of the following signs, seek medical attention:

  • Amnesia
  • Difficulty speaking or recalling words
  • Trouble concentrating or thinking clearly
  • Abnormal laughing or crying
  • Mood swings
  • Impulsive behavior
  • Blurred vision
  • One or both pupils dilated
  • Dizziness
  • Balance issues
  • Persistent headaches
  • Seizures
  • Ringing ears

This is not a complete list— there are more signs and symptoms of TBIs out there.

Can You Treat a Traumatic Brain Injury?

Yes. And if you’re in Chicago, you have your pick of rehabilitation centers for brain injuries. First and foremost, you need to see your primary physician or an emergency room doctor as soon as possible.

If you have a head injury, you need to do two things: seek help and prevent further injury. If you have your cellphone, call emergency services. If you aren’t alone, stay still and let whoever is with you handle calling. You want to move as little as possible outside a doctor's instruction. If you don’t notice the injury until later, do not drive yourself. Ambulance costs can be expensive, but driving with a TBI is a terrible idea. Either have someone drive you, call a taxi or a rideshare, or take the ambulance.

For immediate treatment, your doctor will work to stabilize you. They need to monitor your blood pressure, flow, and oxygenation in an effort to reduce harmful consequences. Once you are stable, they will perform an exam and diagnostics to determine what type of TBI you have and the extent of any damage.

After diagnostics and initial rest, it’s time to look at recovery. It’s important to know that brain damage cannot be reversed. However, some of the effects of the damage can be helped. With a combination of therapies and medications, you can relearn things like mobility, self-care, communication, and more. Unfortunately, all of this can get very expensive. On the bright side, you may not be liable to pay for it.

Seeking Justice— and Compensation —For Your Traumatic Brain Injury

Most traumatic experiences happen because of someone else’s negligence or harmful actions. If you are not the at-fault party, or if you are only partially at fault, you may be able to receive compensation. Now, workplace accidents get a bit more complicated. In Illinois, your employer is required to carry worker’s compensation insurance, but this means different forms and deadlines. Outside of workplace accidents, you’re looking at having to prove a claim against the at-fault party’s insurance or filing a lawyer.

You probably don’t need us to tell you that you should not tackle this process alone. Chicago is home to expert brain injury lawyers who can help. Once they have the basic information, your lawyer will help you gather more evidence and expert testimony. Then, they will help you calculate damages; these include things like lost wages and medical costs. Your lawyer will ensure that any paperwork is turned in on time, and they will handle communications and negotiations with the other parties.

During this time, there are some things you need to avoid:

  • Apologizing about the accident. This can be seen as an admission of fault.
  • Discussing the case or posting about it on social media.
  • Signing anything without speaking to your lawyer.
  • Speaking to the other parties.
  • Speaking to news outlets.

If anyone tries to talk to you or get you to sign something, you should give them your lawyer’s information and end the conversation. Some shady adjustors and lawyers may try to trick you into signing away your rights to compensation or a trial to protect their own bottom line. And it can be easy for someone to twist your words in a way that harms your claim.

Your lawyer will guide you through the negotiation process, right up to signing a settlement or being awarded compensation by the court. Leave everything to them and instead focus on your health.
