Understanding the Impact of Remarriage on Existing Child Custody Arrangements

Divorce is a difficult and painful time, especially when there are children involved. Thankfully, over half of divorcees do go on to find love and remarry, but this can create some challenges where custody is involved. Child custody modification in Houston is based on sound principles of the best interests of the child/ren. So it won't always be necessary, even after remarriage, to make any changes.

Does a Parent Remarrying Change Child Custody Arrangements?

The short answer to this is no, not directly. The remarriage of either a custodial or non-custodial parent will not automatically trigger the modification of child custody. When the Custodial Parent Remarries

The custodial parent remarrying is the situation that is most likely to have an impact on the child/ren's wellbeing. The new spouse will be entering their primary home, and this could alter the dynamics.

Positive Changes

Change in Financial Circumstances

A new spouse entering the home could mean the child/ren's financial circumstances improve due to the second income. Married couples are much less likely to be in poverty than single people.

Addition of a Caring Stepparent

An additional adult to love and care for the child/ren will be viewed as a positive change in the eyes of the court.

Potential Negative Impacts of Remarriage

A new stepparent can also bring some negative impacts, and these could have a bearing on a child custody modification. For example, a stepparent who favors their own children and unfairly punishes their stepchild/ren would have a negative effect on the child/ren's wellbeing.

If the stepparent brings with them additional children, this might mean that there are fewer resources for the child/ren from the first marriage. Or, if the new marriage is unstable and full of strife, this could negatively affect the child/ren's well-being.

Is It Grounds for Child Custody Modification in Houston?

The Texas family courts have the primary goal of fostering the best interests of the child/ren involved. This is known as the Best Interest of the Child Standard. If the remarriage would negatively affect a child, this could be used as grounds for a child custody modification or a change in visitation.

When the Non-Custodial Parent Remarries

Generally, this has less impact on the child/ren, so it wouldn't normally trigger a child custody modification. The majority of the time, the courts will consider the remarriage of a non-custodial parent as a positive thing. It creates a more stable home environment for the child/ren than if the parent remained single.

Is It Grounds for Child Custody Modification?

A more stable home environment, a new loving stepparent, and a better financial situation could be used as grounds to increase visitation or even apply to become the custodial parent if it would benefit the child/ren.

As with the remarriage of a custodial parent, there can sometimes be a negative impact on the child/ren's wellbeing. This is especially the case if the new spouse brings discord and instability, if they are hostile towards the child/ren, or if new children disrupt the consistency of co-parenting. In this case, visitation could be reduced.

A remarriage of either the custodial or non-custodial parent will not automatically trigger a change in child custody. It can, however, create a situation where a change could be justified in court, in the best interests of the child/ren.
